How do I convince the Medicaid caseworker that Mom did not give money for the purpose of getting on Medicaid?

My Mother gave two $1000 gifts just over 3 years ago strictly to charity, not to me. The gifts were to local charities: one for a scholarship fund for a local college. The other gift was for her local church. Mom hates getting on Medicaid. In fact, she refuses to discuss the issue with me.She may need Medicaid in the next few months, as she is in a nursing home.

I THINK if you can demonstrate that was within the realm of what she was typically giving every year it might be OK. It is not forbidden to give to charity while you can. You might have to consult an eldercare lawyer or estate planner.

It's really not up to the caseworker, unfortunately. Medicaid imposes a penalty for gifts, plain and simple. So mom has to come up with the first $2000 to pay for her care. Ask the nursing home to help you with a payment plan.
