Can a sister get power of attorney legally while said person is married and not separated from her husband without his consent?
the sister is terminally ill and she has cleaned out her bank account, and God know what else while she had her in another state, too sick to make a decision
I can't quite follow the relationships in you post, but it doesn't matter. A person can name anyone as their POA, it doesn't have to be a spouse, and they can change their POA as often as they want to. It would be best if the ex and all banks etc where the former POA was registered are sent a notice of the changes.
